On the occasion of the launch of the "Internal System for the Protection of People who report Regulatory Infractions and the Fight Against Corruption in Cartagena Puerto de Culturas" , the " Informant's Mailbox " is established under Law 2/2023, of February 20, regulating the protection of people who report regulatory infractions and the fight against corruption.
It includes all communications that relate to:
- Infringements of European Union Law when they affect any of the matters indicated in Annex I of the Whistleblowing Directive, affect the financial interests of the Union or affect the internal market;
- Serious or very serious administrative infractions ;
- Criminal acts .
Exceptions are communications related to classified information or that may affect the security of the State, and those that are not within the scope of protection of Law 2/2023.
The following communications will not be investigated:
a) In the event that the events described do not refer to the actions or omissions that are within the scope of application of Law 2/2023 and/or are not related to the activity and operation of Cartagena Puerto de Culturas , without prejudice to the possibility of carrying out another type of investigation related to the competencies of Human Resources.
b) When they lack foundation or plausibility. As well as when they lack essential content, are unintelligible or are formulated in a vague or excessively generic way , and have not been corrected.
c) When they are manifestly repetitive , unless new factual or legal circumstances are apparent that justify a new investigation. It will be understood that this cause exists when it does not contain new and significant information about previous communications that were previously inadmissible or duly investigated.
d) In those cases that have an abusive or unjustified nature, when appreciating that the purpose pursued with their presentation is not to carry out an investigation .
e) In those cases in which they refer to alleged irregularities that have their own specific natural procedure . However, if signs of abnormal operation of the services of Cartagena Puerto de Culturas are deduced, the appropriate actions may be initiated.
When the facts could indirectly constitute a crime, the information will be sent to the Public Prosecutor's Office immediately.
